When the whole estate is set apart for a year's support, as provided in Code Section 53-5-2, the surviving spouse may pay so much and such parts of the debts of the deceased spouse as the surviving spouse may think proper, consistent with the spouse's means, with the advice and consent of the judge of the probate court.
