53-3-45. (Pre-1998 Probate Code) Probate when resident executor refuses to seek probate or when named executor is nonresident


If a resident executor refuses to offer a foreign will for probate or if the executor nominated in the foreign will is not a resident of this state, the foreign will may be probated at the instance of any heir, legatee, distributee, devisee, or creditor of the testator, and letters shall issue to an administrator with the will annexed. The administrator shall be a resident of this state and shall be selected according to the rules provided in this title for selecting administrators.
