2006 Georgia Code - 53-12-24

53-12-24. (a) The trustee must have legal capacity under Georgia law to acquire, hold, and transfer title to property. If the trustee is a corporation, it must have the power to act as a trustee in Georgia. (b) The fact that the person named as trustee is also a beneficiary does not of itself incapacitate the person from acting as trustee. (c) The settlor of a trust may be the trustee of the trust.
