2006 Georgia Code - 49-4-150
49-4-150. The Board of Community Health is directed to
prescribe regulations governing the custody, use, and preservation
of the records, papers, files, and communications of the Department
of Community Health relating to applicants for and recipients of
medical assistance. Except as otherwise provided in Code Section
49-4-151, such regulations shall provide safeguards restricting the
use or disclosure of information concerning applicants for or
recipients of medical assistance to purposes directly connected
with the administration of the state plan. No person who obtains
information by virtue of any such regulations shall use such
information for commercial or political purposes, and any person
seeking such information shall certify to the commissioner of
community health, in writing, that the information obtained will
not be used for commercial or political purposes.
