19-14-9. (a) The commission may authorize the disbursement of available money from the trust fund after appropriation thereof to an entity or program eligible pursuant to the criteria of the commission for exclusively the following purposes, which are listed in the order of preference for expenditure: (1) To fund a private nonprofit or public organization in the development or operation of a prevention program if at least all of the following conditions are met: (A) The organization demonstrates a broad-based community involvement emphasizing volunteer efforts and a demonstrated expertise in child abuse prevention issues; (B) The organization demonstrates an ability to match, through money or in-kind services, a minimum of 50 percent of the amount of any trust fund money received. The amount and types of in-kind services are subject to the approval of the commission; (C) The organization demonstrates a willingness and ability to provide program models and consultation to organizations and communities regarding program development and maintenance; and (D) Other conditions that the commission may deem appropriate; (2) To fund services or facilities connected with child abuse and neglect prevention; and (3) To fund the commission created in Code Section 19-14-3 for the actual and necessary operating expenses that the commission incurs in performing its duties. (b) Authorizations for disbursement of trust fund money under paragraph (3) of subsection (a) of this Code section shall be kept at a minimum in furtherance of the primary purpose of the trust fund which is to disburse money under paragraphs (1) and (2) of subsection (a) of this Code section to encourage the direct provision of services to prevent child abuse and neglect. (c) No funds shall be disbursed from the trust fund to any organization or other entity or for any purpose authorized in subsection (a) of this Code section until approved by the Governor; provided, however, that the Governor may not authorize the disbursement of funds to an organization or other entity which the commission has not recommended for a grant.
