570.191   Agricultural Emergency Eradication Trust Fund.

1570.191  Agricultural Emergency Eradication Trust Fund.--There is created in the office of the commissioner the Agricultural Emergency Eradication Trust Fund. Funds in the trust fund may be made available upon certification by the commissioner that an agricultural emergency exists and that funds specifically appropriated for the emergency's purpose are exhausted or insufficient to eliminate the agricultural emergency. The term "agricultural emergency" means an animal or plant disease, insect infestation, or plant or pest endangering or threatening the horticultural, aquacultural, or other agricultural interests in this state.

A.  Section 46, ch. 2004-269, amended s. 570.191 "[i]n order to implement Specific Appropriation 1358A of the 2004-2005 General Appropriations Act." Specific Appropriation 1358A was vetoed. See ch. 2004-268, the 2004-2005 General Appropriations Act.

B.  Section 75, ch. 2004-269, provides that "[a] section of this act that implements a specific appropriation or specifically identified proviso language in the 2004-2005 General Appropriations Act is void if the specific appropriation or specifically identified proviso language is vetoed. A section of this act that implements more than one specific appropriation or more than one portion of specifically identified proviso language in the 2004-2005 General Appropriations Act is void if all the specific appropriations or portions of specifically identified proviso language are vetoed."

C.  As amended by s. 46, ch. 2004-269, s. 570.191 would have read:

570.191  Agricultural Emergency Eradication Trust Fund.--There is created in the office of the commissioner the Agricultural Emergency Eradication Trust Fund. Funds in the trust fund:

(1)  May be made available upon certification by the commissioner that an agricultural emergency exists and that funds specifically appropriated for the emergency's purpose are exhausted or insufficient to eliminate the agricultural emergency. The term "agricultural emergency" means an animal or plant disease, insect infestation, or plant or pest endangering or threatening the horticultural, aquacultural, or other agricultural interests in this state.

(2)  May be appropriated for insect control. This subsection expires July 1, 2005.
