560.108   Administrative enforcement guidelines.

560.108  Administrative enforcement guidelines.--

(1)  In imposing any administrative remedy or penalty provided for in the code, the department shall take into account the appropriateness of the penalty with respect to the size of the financial resources and good faith of the person charged, the gravity of the violation, the history of previous violations, and such other matters as justice may require.

(2)  All administrative proceedings pursuant to the code shall be conducted in accordance with chapter 120. Any service required or authorized to be made by the department under the code 1must be made by certified mail, return receipt requested, delivered to the addressee only by personal delivery or in accordance with chapter 48. The service provided for in this subsection is effective on the date of delivery.
