Chapter 442 Occupational Safety And Health  
442.021   Carrier penalties.

1442.021  Carrier penalties.--If any carrier violates, or fails or refuses to comply with, this chapter or with any rule adopted or order issued under this chapter, the division, after notice and hearing in accordance with chapter 120, assess against the carrier a civil penalty of not less than $100 nor more than $5,000 each day the violation, failure, or refusal continues after the carrier has been given written notice thereof. The total penalty for each violation, failure, or refusal may not exceed $50,000. The division shall adopt rules providing for penalties for noncompliance with this chapter by carriers.
