§ 2101. Purposes of this chapter [Effective July 1, 2026].

It is the purpose of this chapter to reform the system governing the release of defendants pending a final determination of guilt of such persons. The various courts of this State shall make individualized decisions about terms and conditions of pretrial release or the need for preventive detention. Each court shall utilize a system of pretrial release aimed at imposing the least restrictive conditions of release so as to account for each defendant's fundamental right to pretrial liberty while also reasonably assuring the appearance of the defendant at court proceedings, reasonably assuring the protection of the community, victims, witnesses, and any other person, and reasonably maintaining the integrity of the judicial process, such that the defendant will not obstruct or attempt to obstruct justice.
