Section 45a-113b. - *(See end of section for amended version and effective date.) Payment of fees by credit card, charge card, debit card or electronic funds transfer. Service fee.

Each court of probate may allow the payment of any fees charged by such court by means of a credit card, charge card, debit card or an electronic funds transfer and may charge the person making such payment a service fee for any such payment made by any such card or electronic funds transfer. The fee shall not exceed any charge by the card issuer or processing fee for electronic funds transfer, including any discount rate.

*Note: On and after July 1, 2022, this section, as amended by section 442 of public act 21-1 of the June special session, is to read as follows:

“Sec. 45a-113b. Payment of fees by credit card, charge card or debit card. Service fee. Each Probate Court may allow the payment of any fees charged by such court by means of a credit card, charge card or debit card. Such court shall charge the person making such payment a service fee for any such payment made by means of any such card. The fee shall not exceed any charge by the card issuer, including any discount rate. The Probate Court Administrator shall determine the rate or amount of the service fee for any such card in accordance with subsection (c) of section 1-1j.”

History: P.A. 13-247 effective July 1, 2013; P.A. 21-100 added references to electronic funds transfer, effective July 1, 2021; June Sp. Sess. P.A. 21-2 amended section to require the charging of a service fee, add provision re rate or amount of service fee and make a technical change, effective July 1, 2022.
