§ 42-4-1712. Procedure Prescribed Not Exclusive

The foregoing provisions of this article shall govern all police officers in making arrests without a warrant or issuing citations for violations of this article, for offenses or infractions committed in their presence, but the procedure prescribed in this article shall not otherwise be exclusive of any other method prescribed by law for the arrest and prosecution of a person for an offense or infraction of like grade.

ANNOTATION

Annotator's note. Since § 42-4-1712 is similar to § 42-4-1507 as it existed prior to the 1994 amending of title 42 as enacted by SB 94-1, relevant cases construing that provision have been included with the annotations to this section.

Section relates to other procedures concerning arrest. Section 42-4-1507 does not allow noncompliance with the mandate of § 42-4-1505 ; rather, § 42-4-1507 relates to other procedures concerning arrest. People v. Overlee, 174 Colo. 202 , 483 P.2d 222.

The inclusion of the word “otherwise” in this section was not meant to give exclusive jurisdiction to a county judge in those cases where the alleged offense was committed in the presence of the arresting officer. People v. Griffith, 130 Colo. 475 , 276 P.2d 559 (1954).
