Article 37 - Contracts With Health Care Providers
§ 25-37-114. Enforcement

Universal Citation: CO Code § 25-37-114 (2021)
  1. With respect to the enforcement of this article, including arbitration, there shall be available:
    1. Private rights of action at law and in equity;
    2. Equitable relief, including injunctive relief;
    3. Reasonable attorney fees when the health-care provider is the prevailing party in an action to enforce this article, except to the extent that the violation of this article consisted of a mere failure to make payment pursuant to a contract;
    4. The option to introduce as persuasive authority prior arbitration awards regarding a violation of this article.
  2. Arbitration awards related to the enforcement of this article may be disclosed to those who have a bona fide interest in the arbitration.
