Article 90.5. Geothermal Resources
Section 37-90.5-108. Geothermal management districts.

(1) The state engineer may adopt procedures under which geothermal management districts may be established. In such districts, the state engineer has the authority to:

  1. Control well-spacing and production rates;

  2. Control the quantity of geothermal fluid extracted from geothermal resources by suchmethods and procedures as he deems appropriate, including requirements to reinject;

  3. Adopt a comprehensive plan for the most efficient use of geothermal resources, guided by the principles of equitable apportionment, maximum economic recovery, and prevention of waste.

(2) The state engineer may delegate some or all of his authority under this section to a geothermal management district upon finding that the district has adequate organization and capability to administer an acceptable management plan.
