Article 44. Internal Improvement Districts Law of 1923
Section 37-44-103. Powers of district.

(1) Any district organized under this article has the power, whenever necessary or expedient to promote the object of the district:

  1. To provide for the drainage of lands whether lying within or without the boundariesof such district;

  2. To acquire by condemnation or otherwise such lands as are necessary for the construction, operation, and maintenance of such ditches, canals, drains, or other works as are required for the drainage of such lands;

  3. To accept grants or loans of money from the federal government, or any departmentor agency thereof, for the construction of such drainage ditches, canals, drains, or other works, and to enter into such contracts for the maintenance of such drainage system as are necessary to be entered into in order to procure any such grant of money or other federal aid in the construction of such drainage system;

  4. In general, to contract with the federal government, or any department or agencythereof, in such manner as shall be found necessary or advisable in order to procure federal aid in any form in the construction of any such drainage system;

  5. To provide means for the maintenance of and to maintain and operate such drainagesystem when so constructed or acquired.
