§ 27-82-109. Records of persons with substance abuse disorders and persons under influence of drugs

(1) The registration and other records of treatment facilities shall remain confidential and fully protected as outlined in federal confidentiality regulations for alcohol and drug abuse patient records found at 42 CFR, part II, secs. 2.1 to 2.67, as amended.

(2) Notwithstanding subsection (1) of this section, the director may make available information from patients' records for purposes of research into the causes and treatment of substance use disorders. Information pursuant to this subsection (2) must not be published in a way that discloses patients' names or other identifying information.
