Article 5.5 - Rights-of-Way: Telecommunications Providers
§ 38-5.5-105. Power of companies to contract
Any domestic or foreign telecommunications provider shall have power to contract with any person or corporation, the owner of any lands or any franchise, easement, or interest therein over or under which the provider's conduits, cable, switches, and related appurtenances and facilities are proposed to be laid or created for the right-of-way for the construction, maintenance, and operation of such facilities and for the erection, maintenance, occupation, and operation of offices at suitable distances for the public accommodation.
