Article 5.5 - Rights-of-Way: Telecommunications Providers
§ 38-5.5-104. Right-of-way across state land
Any domestic or foreign telecommunications provider authorized to do business under the laws of this state shall have the right to construct, maintain, and operate lines of communication, switches, and related facilities and obtain permanent right-of-way therefor over, upon, under, and across all public lands owned by or under the control of the state, upon the payment of such just compensation and upon compliance with such reasonable conditions as may be required by the state board of land commissioners.
