§ 12-43.3-401. Classes of licenses

(1) For the purpose of regulating the cultivation, manufacture, distribution, and sale of medical marijuana, the state licensing authority in its discretion, upon application in the prescribed form made to it, may issue and grant to the applicant a license from any of the following classes, subject to the provisions and restrictions provided by this article:

(a) Medical marijuana center license;

(b) Optional premises cultivation license;

(c) Medical marijuana-infused products manufacturing license;

(c.5) Medical marijuana testing facility license;

(d) Occupational licenses and registrations for owners, managers, operators, employees, contractors, and other support staff employed by, working in, or having access to restricted areas of the licensed premises, as determined by the state licensing authority. The state licensing authority may take any action with respect to a registration pursuant to this article as it may with respect to a license pursuant to this article, in accordance with the procedures established pursuant to this article.

(e) Medical marijuana transporter license.

(2) All persons licensed pursuant to this article shall collect sales tax on all sales made pursuant to the licensing activities.

(3) A state chartered bank or a credit union may loan money to any person licensed pursuant to this article for the operation of a licensed business. A marijuana financial services cooperative organized pursuant to article 33 of title 11, C.R.S., may accept as a member, loan money to, and accept deposits from any entity licensed pursuant to this article for the operation of a licensed business.
