ARTICLE 1. General

CA Govt Code § 19770 (through 2012 Leg Sess) What's This?

(a) With the exception of Chapter 7.5 (commencing with Section 400) of Part 1 of Division 2 of the Military and Veterans Code, this part, rather than provisions of the Military and Veterans Code, governs leave for military service, rights and benefits accrued during that service, and reinstatement after that service, for executive branch employees. Both the State Personnel Board and the Department of Personnel Administration have responsibilities for carrying out certain provisions of this chapter as provided in subdivision (b).

(b) The State Personnel Board is responsible for the provisions of this chapter pertaining to civil service examinations, list eligibility, appointments, reinstatements, probationary periods, and status. The Department of Personnel Administration is responsible for the provisions of this chapter on eligibility for military leave and the effect of these leaves on the employee s salary, vacation, sick leave, and seniority.

(c) For the purposes of this chapter:

(1) Employee means that term as defined by subdivision (d) of Section 19815.

(2) Civil service employee means an employee legally holding a position in the state civil service.

(3) Exempt employee means an employee who is exempt from the state civil service by Section 4 of Article VII of the California Constitution.
