2009 California Welfare and Institutions Code - Section 14640 :: Article 4. Acute Psychiatric Health Facility Allocations

SECTION 14640

14640.  (a) The State Department of Mental Health shall allocate
funds for the provision of mental health services to Medi-Cal
eligible persons over 20 years of age to counties of over one million
population that own and operate an acute psychiatric health
facility, and in which the number of general acute care hospital
psychiatric beds is 50 or less. Counties receiving allocations
pursuant to this subdivision may contract with privately operated
psychiatric health facilities, or with freestanding psychiatric
hospitals which have been certified to provide care to Medi-Cal
eligible persons.
   (b) Payments made from the allocation established under
subdivision (a) shall be made according to state established
reimbursement formulas for mental health services, and shall be
funded through moneys initially transferred from the State Department
of Health Services and subsequently appropriated to the State
Department of Mental Health under Item 4440-101-001 of the annual
Budget Act.
   (c)  Allocations made pursuant to subdivision (a) shall not exceed
the General Fund share of expenditures made under the Medi-Cal
program for acute psychiatric inpatient care units in general acute
care hospitals in the subject county during the 1989-90 state fiscal
year. Payments shall be made only to the extent that those inpatient
units have ceased operation in subsequent years and the capacity has
not been replaced by capacity in other general acute care hospitals.
