60090.  At or before the time set for the hearing of protests, any
person interested may file a written protest with the clerk stating
that he objects to:
   (a) The formation of the district.
   (b) The extent of the district.
   (c) The proposed improvement, or to the acquisition, construction,
or operation of the proposed utility, or to the special local
service.
   (d) The inclusion of his property in the district.



60091.  The clerk shall endorse on each protest the date he received
it. At the time appointed for the hearing of protests, he shall
present to the legislative body all protests so filed with him.



60092.  The legislative body shall hear the protests at the time
appointed, or at any time to which the hearing is adjourned, and pass
upon them.  Its decision on the protests is final.



60093.  If any protest against the proposed improvement, or against
the acquisition, construction, or operation of the utility, or
against the special local service is sustained, no further
proceedings shall be had pursuant to the petition, but a new petition
to the same or a similar purpose may be filed after six months from
the date the protest was sustained.



60094.  If any protest is against the extent of, or against the
inclusion of property in, the district, the legislative body may make
such changes in the boundaries of the district as it finds proper
and advisable, and it shall define and establish such boundaries.
The legislative body shall not modify the boundaries so as to include
any territory which will not, in its judgment, be benefited by the
improvement, utility, or special local service.



60095.  The legislative body shall not modify boundaries except
after notice of its intention so to do.  It shall give notice by one
insertion in a newspaper described in Section 60063 or, in a city
where no such newspaper is published, by posting in three public
places.  The notice shall describe the proposed modification and
specify a time for hearing objections to the modification, which time
shall be at least 10 days after the publication of notice.



60096.  At or before the time set for such hearing, any interested
person may file a written objection to the proposed modification of
boundaries with the clerk.



60097.  The legislative body shall hear and pass upon the objections
at the time appointed, or at any time to which the hearing is
adjourned.  Its decision on a protest is final.
   If any objection is sustained, no further proceedings pursuant to
the petition shall be taken, but a new petition for the same or a
similar purpose may be filed after six months from the date the
protest was sustained.



60098.  If no protests or objections to a modification of boundaries
are filed at the expiration of the time for filing, or if protests
or objections have been filed and are denied or overruled after
hearing, the legislative body acquires jurisdiction to proceed
pursuant to this chapter.
