UNEMPLOYMENT INSURANCE CODE
SECTION 16000-16002

16000.  This chapter shall be known and may be cited as the Training
and Employment Programs for Older Californians Act of 1983.
16001.  In enacting the Training and Employment Programs for Older
Californians Act of 1983, the Legislature finds and declares that the
number of persons 55 and older has steadily increased during the
period 1970-1981, while the civilian labor force participation of
persons 55-64 years old declined from 5 percent in 1970, to 3 percent
in 1981.  This decline reflects several significant factors,
including the following:
   (a) New technologies, which have made individuals' job skills
obsolete.
   (b) The continuing pattern of age discrimination in employment.
   (c) Withdrawal of many older persons from the labor force due to
discouragement at the lack of employment opportunities.
16002.  It is the intent of the Legislature that services and
activities undertaken pursuant to this chapter shall be provided
pursuant to Section 204 (d) of Title II of the federal Job Training
Partnership Act of 1982 (Public Law 97-300), as amended.  Title IIA
of the Job Training Partnership Act requires that 5 percent of the
state's allotment under that subpart be made available for employment
training of older individuals.  These programs are to be developed
through the State Job Training Coordinating Council in conjunction
with private industry councils, in service delivery areas designated
within the state in accordance with the federal act, and are to be
designed to assure the training and placement of older individuals,
aged 55 and above, who are determined to be eligible in accordance
with Section 204(d)(5) of the Job Training Partnership Act in
employment opportunities with private business concerns.  Provisions
for carrying out this responsibility include the following:
   (a) Following consultation with appropriate private industry
councils and chief elected officials, the State Job Training
Coordinating Council shall recommend to the Governor agreements with
public agencies, nonprofit private organizations, and private
business concerns.
   (b) Consideration is to be given to assisting programs involving
training for jobs in growth industries and jobs reflecting the use of
new technological skills.
