25397.1. Any action taken by the department pursuant to this chapter shall be consistent with all applicable regulations adopted by the State Water Resources Control Board, all applicable water quality control plans adopted pursuant to Section 13170 of the Water Code and Article 3 (commencing with Section 13240) of Chapter 4 of Division 7 of the Water Code, and all applicable state policies for water quality control adopted pursuant to Article 3 (commencing with Section 13140) of Chapter 3 of Division 7 of the Water Code, to the extent the department determines that those regulations, plans, and policies are not less stringent than this chapter and the regulations adopted pursuant to this chapter. 25397.2. The department shall ensure that the public is given the opportunity to participate in response actions taken pursuant to this chapter in accordance with the department's public policy and procedures manual, No. OPP-94-002. 25397.3. Nothing in this chapter shall be construed to restrict the rights of responsible persons and the department to agree upon other voluntary methods of remediation.
