2005 California Government Code Sections 55850-55855 Article 1. General Provisions

SECTION 55850-55855

55850.  This chapter shall be known and may be cited as the
Sacramento Ballpark Authority Law.
55851.  The Legislature finds and declares that the residents,
property owners, communities, and local officials in the Counties of
El Dorado, Placer, Sacramento, San Joaquin, and Yolo lack a local
governmental organization capable of facilitating the construction
and operation of a ballpark suitable for playing professional
baseball.  Recognizing the area's diverse needs and resources, it is
the intent of the Legislature in enacting this chapter to create an
authority under local control to facilitate the construction and
operation of a ballpark suitable for playing professional baseball.
Further, it is the intent of the Legislature that the authority shall
not require any city or county to pay for the construction or
operation of the ballpark.
55852.  As used in this chapter, the following terms have the
following meaning:
   (a) "Authority" means the Sacramento Ballpark Authority formed
pursuant to this chapter.
   (b) "Governing board" means the governing board of the authority.
55853.  This chapter is necessary for the public health, safety, and
welfare of the residents, property owners, and communities of the
Counties of El Dorado, Placer, Sacramento, San Joaquin, and Yolo, and
shall be liberally construed to effectuate its purposes.
55854.  If any provision of this chapter or the application of any
provision of this chapter in any circumstance to any person, city,
county, district, the state, or any agency or subdivision of the
state is held invalid, that invalidity shall not affect other
provisions or applications of this chapter that may be given effect
without the invalid provision or application of the invalid
provision, and to this end the provisions of this chapter are
severable.
55855.  Any action to determine the validity of the organization or
of any action of the authority shall be brought pursuant to Chapter 9
(commencing with Section 860) of Title 10 of Part 2 of the Code of
Civil Procedure.
