- (a) Any driver aggrieved by an entry into his or her record may request that the Office of Driver Services conduct a hearing for the purpose of contesting the information contained in the accident report or the method by which the decision was made to enter the information into the person's record.
- (b)
- (1) The conviction of a person for a traffic violation which caused the accident shall be prima facie evidence of who was primarily at fault in the accident and no hearing shall be held where such evidence exists.
- (2) When appeals are taken from the decision of the trial court for a traffic violation, the Office of Driver Services shall immediately expunge the record of the entry made as a result of the accident report until such time as the appeal becomes final.
