§ 16-96-109. Time of trial

  1. (a) All prosecutions in city courts shall stand for trial immediately, where the defendant is in custody or on bail for the offense charged, or on the day when the defendant has been summoned to appear, but only if the summons was executed within the limits of the court's jurisdiction one (1) day or, elsewhere, ten (10) days before the day on which he or she is warned to appear.

  2. (b) If not executed as provided in subsection (a) of this section, the trial shall be postponed to a day to be fixed by the court.
