23-526. License; examination

A. No person, firm, association or corporation shall act as an employment agent for profit, or receive any fee, charge, commission or other compensation, directly or indirectly, for services as an employment agent without first obtaining from the industrial commission a license therefor, as provided in this article.

B. Prior to the initial issuance of an employment agent license, those persons determined by the commission to be involved in the actual operation of the employment agency shall take a written examination prepared by the director with the assistance of the advisory council. The examination shall be given at least once each month and shall be designed to demonstrate to the commission that the person has sufficient knowledge of the applicable laws and regulations, including, but not limited to:

1. Laws pertaining to employment agents.

2. Rules and regulations pertaining to employment agents.

3. Laws pertaining to employment discrimination.

4. Other pertinent labor laws.
