49-968. Department rules

A. The director shall adopt by rule any substance established by the administrator of the United States environmental protection agency pursuant to the pollution prevention act of 1990 (42 United States Code section 13102(3)). Except for public notice requirements this adoption is exempt from the requirements of title 41, chapter 6. The director shall give public notice pursuant to title 41, chapter 6 of the adoption of substances under this section.

B. The director may, by rule, add or delete a substance to the list of toxic substances based on the same criteria described in the emergency planning and community right to know act (42 United States Code section 11023(d)).
