49-1072 Grants; purposes; priority

49-1072. Grants; purposes; priority

A. Subject to the availability of monies in the grant account, the department may make a grant to an owner or operator of not more than one hundred thousand dollars from the grant account for any of the following purposes:

1. Any actions necessary to meet the tank performance standards prescribed by or pursuant to section 49-1003 or 49-1009, including replacing or retrofitting tanks.

2. Paying the portion of corrective action costs that are determined to be reasonable and necessary costs but that are not covered by the department from the assurance account as prescribed in section 49-1054.

3. Removing the underground storage tank for purposes of closure or replacement.

4. Paying for expedited review of a claimant's work plan, site characterization reports, corrective action plans, monitoring reports and other information as prescribed in section 49-1052.

B. The department shall establish criteria for determining priorities among the grant applicants under this section. The criteria shall include the need for financial assistance, the age of the tank, the risk to human health and the environment, the geographic extent of the area served by the grantee and the availability of alternative services to the community.
