41-1349. Duties relating to historical value A. The state library shall: 1. Determine whether public records presented to it are of historical value. 2. Dispose of records determined to be of no historical value. 3. Accept those records deemed by a public officer having custody of the records to be unnecessary for the transaction of the business of the public officer's office and deemed to be of historical value. B. All public records of any public office, upon the termination of the existence and functions of the office, shall be checked by the state library and either disposed of or transferred to the custody of the state library, in accordance with this article. If a public office is terminated or reduced by the transfer of its powers and duties to another office or to other offices, its appropriate public records shall pass with the powers and duties transferred. |
