36-2907.02 Benchmark benefit package

36-2907.02. Benchmark benefit package A. The administration shall establish a benchmark benefit package pursuant to section 6044 of the deficit reduction act of 2005 and section 1937 of the social security act. B. Enrollment in the benchmark benefit package is mandatory for persons who are eligible pursuant to: 1. Section 36-2901.01 as covered under the section 1115 waiver and who are not covered under the state plan. 2. Section 36-2924. C. Enrollment in the benchmark benefit package is optional for all other title XIX eligible persons. D. This section shall be implemented subject to approval of the benchmark benefit package from the centers for medicare and medicaid services and on the condition that any changes to health benefits under this section would not jeopardize the state's ability to receive any enhanced federal matching rate. |
