23-737.02 Recovery of collection costs; fee for bad checks

23-737.02. Recovery of collection costs; fee for bad checks A. A debtor who fails to pay any contributions, payments in lieu of contributions, penalties, interest or fees imposed under this chapter is liable for all costs and expenses incurred by the department to collect these amounts. The department may collect these costs and expenses at the time of collecting the delinquent contributions, payments in lieu of contributions, penalties, interest and fees. B. The department may charge and collect a fee of twenty-five dollars from any person who offers a check, draft, negotiable order of withdrawal or similar instrument drawn on a bank or other depository institution in full or partial payment of an amount due under this chapter if the instrument is not paid or is dishonored by the institution. The department may waive the fee if the person shows good cause for the nonpayment or dishonor of the instrument. |
