2005 Arizona Revised Statutes - Revised Statutes §49-153  Greenfields pilot program; eligibility

A. The greenfields pilot program is established to provide for the redevelopment or other use of parcels of land that have soil contamination. The program shall consist of not more than one hundred sites that are owned by persons who voluntarily apply to the program and that are certified by a remediation specialist who is certified pursuant to section 32-131 to be a site that is subject to soil contamination that has not impacted groundwater.

B. Sites that are classified as underground storage tank remediation sites are not eligible for the greenfields pilot program if monies are sought from the underground storage tank assurance account established by section 49-1051. The following sites are not eligible for inclusion in the greenfields pilot program:

1. Sites that are the subject of a current civil or criminal enforcement action by the department of environmental quality or the United States environmental protection agency.

2. Sites which are permitted facilities under title 49 that have experienced a release to the soil which is in violation of the permit conditions.
