2005 Arizona Revised Statutes - Revised Statutes §48-2105  Tally of votes; order declaring formation of district; failure to establish district; costs of proceedings

A. The board of supervisors shall tally the votes at its next regular meeting after the election has been held, and if the board finds that a majority of the registered voters voting has voted in favor of the establishment of the district, the board shall declare the district established. The board shall notify the five candidates for director receiving the greatest number of votes that they have been elected directors of the "(name of district) pest abatement district". Certified bills covering the costs incurred by the board in conducting the hearing and election shall be presented to the directors and paid from the monies of the district.

B. The clerk of the board shall file a certified copy of the order of the board's declaration establishing the district with the county recorder and the secretary of state.

C. If the board finds that the votes cast are insufficient to establish the district, the board shall dismiss the petition and charge the costs incurred in conducting the hearing and election against the signers of the petition. Each petition for the purpose of calling a hearing and election shall display at the top of each page a statement that the petitioners shall be held responsible for the costs incurred in conducting the hearing and election if the election fails.
