2005 Arizona Revised Statutes - Revised Statutes §48-2103 Notice of hearing on petition; certification of enumerated pest
A. Upon receiving the petition, the board shall set a date for a hearing on the petition not less than fifteen nor more than thirty days from the date it is received and shall publish the notice of purpose, date, time and place of the hearing in the same manner in which other public hearings before the board are published.
B. The clerk of the board shall compare the signatures, addresses and acreages set forth in the petition with the county assessment roll and shall certify its adequacy to the board.
C. The board shall request a certification from the Arizona department of agriculture and the county health officer familiar with insects and rodents, or both, that the pest enumerated in the petition has invaded or threatens to invade the boundaries of the proposed district. The receipt of this certification by the board of supervisors is prima facie evidence that the pest is a public nuisance to persons or property in the district.
