2005 Arizona Revised Statutes §41-619  Arizona uniform plumbing code commission; code; variance

A. The Arizona uniform plumbing code commission is established consisting of the registrar of contractors or the registrar's designee and sixteen members appointed for three year terms by the governor. Membership of the commission consists of:

1. Four plumbing contractors who are licensed pursuant to title 32, chapter 10, article 2, no more than two of whom hold exclusively residential licenses.

2. Two mechanical engineers who are registered pursuant to title 32, chapter 1 and who practice in plumbing.

3. One architect who is registered pursuant to title 32, chapter 1.

4. Four certified municipal plumbing inspectors who represent the southern, central and northern regions of this state, one of whom shall be a representative of a county government.

5. Three members of the general public who have no occupational or professional connection to city, town or county governments or to the plumbing industry, one of whom shall have at least two years of experience in the application and use of natural gas.

6. One member who shall represent the piping industry progress and education trust.

7. One member who shall represent the utility and sewer workers.

B. The Arizona uniform plumbing code commission shall:

1. Elect a chairperson from among its members.

2. Meet at least once each year and at additional times on the call of the chairperson or a majority of its members.

3. Adopt, by rule, a state plumbing code by May 1, 1998. The plumbing code adopted shall be based on a plumbing code promulgated by a national organization or association that is organized for the purpose of developing plumbing standards. The state plumbing code shall not contain any provision pertaining to licensing, and any provision of the uniform plumbing code that may be adopted as the state plumbing code that pertains to licensing shall not apply.

4. Adopt periodic amendments to the state plumbing code.

C. A city, town or county may grant variances to the state plumbing code on an individual project basis.

D. The commission may adopt amendments to the state plumbing code, including amendments previously adopted in geographical regions that are only applicable to designated geographical regions within the state.

E. Members of the Arizona uniform plumbing code commission are not eligible for compensation or reimbursement of expenses.

F. The Arizona uniform plumbing code commission is subject to the requirements of chapter 6 of this title.

G. The registrar of contractors shall provide meeting space for the Arizona uniform plumbing code commission to conduct its meetings.
