2005 Arizona Revised Statutes - Revised Statutes §28-7744 Incorporation requirement; eminent domain restriction
A. An operator shall be incorporated under the laws of this state.
B. An operator is not entitled to exercise the power of eminent domain to acquire lands, estates or interests in lands or estates or any other property used by the operator for the construction or enlargement of a roadway pursuant to this article.
