2005 Arizona Revised Statutes - Revised Statutes §28-5013  Hearing

A. On determining that grounds for cancellation of a license exist, the director shall give written notice to the licensee and by the notice shall require the licensee to appear before the director at a specified time and place to show cause why the license should not be cancelled. At the time and place fixed by the director, which is at least ten days after the notice, the licensee shall appear and be heard and may have other persons the licensee desires be present and testify at the hearing.

B. The director shall issue subpoenas to persons the licensee requests requiring them to be present and to testify at the hearing.

C. A transcript of the testimony of witnesses taken at the hearing shall be made and preserved.

D. Within ten days after the hearing, the director shall:

1. Make written findings of fact and conclusions.

2. By order either cancel or decline to cancel the license.

E. If the license is cancelled, the licensee may seek judicial review under title 12, chapter 7, article 6 within thirty days after the date of cancellation. The order of cancellation shall not be suspended during pendency of the appeal.
