Sec. 26.05.715. Solicitation.

Universal Citation: AK Stat § 26.05.715 (2017)

(a) A member of the militia who solicits or advises another or others to desert in violation of AS 26.05.585 or to mutiny in violation of AS 26.05.594 may, if the offense solicited or advised is attempted or committed, be punished with the punishment provided for the commission of the offense, but, if the offense solicited or advised is not attempted or committed, the member may be punished by up to one year of confinement, by separation with characterization up to dishonorable discharge, and by such other punishment as a court-martial may direct.

(b) A member of the militia who solicits or advises another or others to commit an act of misbehavior before the enemy in violation of AS 26.05.599 or an act of sedition in violation of AS 26.05.594 may, if the offense solicited or advised is committed, be punished with the punishment provided for the commission of the offense, but, if the offense solicited or advised is not committed, the member may be punished by up to one year of confinement, by separation with characterization up to dishonorable discharge, and by such other punishment as a court-martial may direct.
