IN THE UTAH COURT OF APPEALS ----ooOoo---Michael Gray and David Medina, Plaintiffs and Appellant, v. Days Inn Central, Defendant and Appellee. ) ) ) ) ) ) ) ) ) MEMORANDUM DECISION (Not For Official Publication) Case No. 20050716-CA F I L E D (November 25, 2005) 2005 UT App 508 ----Third District, Salt Lake Department, 020903595 The Honorable Joseph C. Fratto Jr. Attorneys: Michael Gray, Salt Lake City, Appellant Pro Se Barbara K. Berrett and Mark D. Taylor, Salt Lake City, for Appellee ----- Before Judges Davis, McHugh, and Thorne. PER CURIAM: Michael Gray appeals the trial court's grant of summary judgment in favor of Days Inn Central. This is before the court on its own motion for summary disposition. Gray's docketing statement fails to identify an issue for review on appeal. Instead, it presents a list of excuses that may explain why Gray failed to timely respond to the summary judgment motion below. However, these excuses have no relevancy on appeal because they do not assert trial court error. Because Gray states no issue for review on appeal, there is no substantial issue for review warranting further consideration by this court. See Utah R. App. P. 10(e). Accordingly, the trial court's order is affirmed. ______________________________ James Z. Davis, Judge ______________________________ Carolyn B.
