TEXAS COURT OF APPEALS, THIRD DISTRICT, AT AUSTIN NO. 03-04-00610-CV Jeffrey R. Boggess, Appellant v. Martha Boggess, Appellee FROM THE DISTRICT COURT OF TRAVIS COUNTY, 201ST JUDICIAL DISTRICT NO. FM403861, HONORABLE SUZANNE COVINGTON, JUDGE PRESIDING MEMORANDUM OPINION Jeffrey R. Boggess filed his notice of appeal on September 30, 2004. This Court abated this appeal on April 21, 2005 after Jeffrey Boggess notified us of his filing for bankruptcy. See Tex. R. App. P. 8.1, 8.2. Our abatement informed the parties that failure to notify the Court that the bankruptcy proceeding had concluded could result in the dismissal of this appeal for want of prosecution. After the abatement, no party to this appeal sought reinstatement or otherwise advised of the status of the bankruptcy proceeding. See Tex. R. App. P. 8.3. We have now been informed that the bankruptcy case related to this appeal concluded on March 30, 2007.1 On November 14, 2016, this Court notified the parties that this appeal would be dismissed for want of prosecution unless they filed a status report providing reason to retain this appeal. See Tex. R. App. P. 42.3(b). None of the parties have provided any reason for retention. 1 We considered this appeal as part of an ongoing review of cases that were abated for bankruptcy but did not reflect a final disposition or current status report from the parties. We dismiss this appeal for want of prosecution. __________________________________________ Jeff Rose, Chief Justice Before Chief Justice Rose, Justices Field and Bourland Dismissed for Want of Prosecution Filed: March 22, 2017 2
