The identical issues in this case were addressed by the Houston Court of Appeals in Texas Department of Public Safety v. Woods. Dep t of Pub. Safety v. Woods, No. 01-01-00323-CV, 2002 LEXIS 13 (Tex. App. Houston [1st Dist.] Jan. 3, 2002). We refer to that case for discussion of the facts and pertinent law. Id. For the same reasons stated therein, the judgment of the trial court in this case is also reversed. //
