In The Court of Appeals Ninth District of Texas at Beaumont _________________ NO. 09-17-00088-CV _________________ IN RE INTERNATIONAL PAPER COMPANY ________________________________________________________________________ Original Proceeding 60th District Court of Jefferson County, Texas Trial Cause No. E-0195964 ________________________________________________________________________ MEMORANDUM OPINION International Paper Company, Relator, filed a petition for a writ of mandamus, in which Relator asked this Court to compel the trial court to vacate an order compelling discovery and to sustain Relator’s objections to one topic of a corporate representative’s deposition. On March 23, 2017, we temporarily stayed examination by deposition on the topic in dispute and requested a response from the real parties in interest, Signature Associates, LLC, Signature Special Services, LLC, and Signature Industrial Services, LLC. 1 Relator filed an agreed motion to dismiss the mandamus proceeding as moot because the real parties in interest agreed to withdraw the notice of deposition on the objected-to topic. The motion is granted. We lift the stay order previously entered in this proceeding, and we dismiss this original proceeding without reference to the merits and without prejudice. PETITION DISMISSED. PER CURIAM Submitted on April 12, 2017 Opinion Delivered April 13, 2017 Before McKeithen, C.J., Kreger and Horton, JJ. 2
