Valenzuela, Justice Delivered and Filed: December 8, 2021 PETITION FOR WRIT OF MANDAMUS DENIED AS MOOT On November 12, 2021, Relator filed a petition for writ of mandamus and an emergency motion. The motion asked this court to stay the trial court’s November 10, 2021 order denying the Attorney General’s motion to quash his deposition and for protection pending final disposition of his petition for writ of mandamus. On November 15, 2021, we granted the emergency motion, stayed the trial court’s November 10, 2021 order, and requested a response. This proceeding arises out of Cause No. 2021CI00942, styled Ken Paxton, in his official capacity as Attorney General of Texas v. William McManus, in his official capacity as Chief of the San Antonio Police Department, pending in the 45th Judicial District Court, Bexar County, Texas, the Honorable Mary Lou Alvarez presiding. 1 04-21-00507-CV On December 1, 2021, Real Party in Interest filed an unopposed motion to dismiss or, in the alternative, a motion to deny Relator’s petition as moot. The response notes that on November 23, 2021, the trial court signed a final judgment that dismissed the suit in its entirety with prejudice. Because the trial court’s final judgment effectively grants Relator the relief he sought in his petition, we grant Real Party in Interest’s motion, lift our November 15, 2021 stay, and deny Relator’s petition as moot. See TEX. R. APP. P. 52.8(a). PER CURIAM -2-
