DISMISSED IN PART

Appellant Martin Wright Gordon, Jr. and Appellee Consolidated Electrical Distributors, Inc. ("Consolidated") have filed a joint motion to partially dismiss this appeal. Gordon and Consolidated settled their dispute between them and ask this court to dismiss with prejudice Gordon's appeal against Consolidated. We grant the motion and partially dismiss the appeal. See Tex. R. App. P. 42.1(a). Appellant Gordon's appeal against Appellee Consolidated is dismissed with prejudice. Appellant Gordon's appeal against Appellee J.T. Vaughn Construction Co., Inc. d/b/a Vaughn Construction remains pending in this Court.

Gordon and Consolidated also request that we order each side to pay their own costs. Therefore, costs of Gordon's appeal against Consolidated are taxed against the party incurring same. See id. 42.1(d).
