In the Interest of Baby Girl Garza, A Child--Appeal from 45th Judicial District Court of Bexar County

Annotate this Case
MEMORANDUM OPINION
No. 04-03-00374-CV
IN THE INTEREST OF B.G.G., a Child
From the 45th Judicial District Court, Bexar County, Texas
Trial Court No. 2003-PA-00502
Honorable Andy Mireles, Judge Presiding

PER CURIAM

Sitting: Alma L. L pez, Chief Justice

Catherine Stone, Justice

Paul W. Green, Justice

Delivered and Filed: August 6, 2003

DISMISSED

A copy of appellant's notice of appeal was filed in this court on May 14, 2003. On the same day, the clerk of the court notified the appellant in writing that our records did not reflect that the filing fee in the amount of $125 was paid. Because our record contains no evidence that appellant is excused by statute or rule from paying the filing fee, see Tex. R. App. P. 5, 20, we ordered appellant to show cause that either: (1) the filing fee had been paid; or (2) appellant is entitled to appeal without paying the filing fee.

On June 25, 2003, appellant responded to our order by requesting additional time to obtain the money necessary to retain an attorney and to review the case documents. Our record reflects that the parental termination order appellant seeks to appeal was signed on March 19, 2003; therefore, appellant has had three months in which to obtain the money needed to pay the $125 filing fee. Given the amount of time that has passed since the parental termination order was signed, appellant's request for additional time is denied, and this appeal is dismissed for failure to pay the required filing fee. See Tex. R. App. P. 5, 42.3(c).
