Petition for Writ of Mandamus Denied and Memorandum Opinion filed December 5, 2017. In The Fourteenth Court of Appeals NO. 14-17-00905-CV IN RE CYNTHIA K. KIRKPATRICK AND NEIL DEAN KIRKPATRICK, Relators ORIGINAL PROCEEDING WRIT OF MANDAMUS 434th Judicial District Court Fort Bend County, Texas Trial Court Cause No. 14-DCV-217819 MEMORANDUM OPINION On November 17, 2017, relators Cynthia K. Kirkpatrick and Neil Dean Kirkpatrick filed a petition for writ of mandamus in this court. See Tex. Gov’t Code Ann. § 22.221 (West Supp. 2017); see also Tex. R. App. P. 52. In the petition, relators ask this court to compel the Honorable James H. Shoemake, presiding judge of the 434th Judicial District Court of Fort Bend County, to set aside his February 20, 2017 order denying their motion for summary judgment. Relators have not shown that they are entitled to mandamus relief. Accordingly, we deny relators’ petition for writ of mandamus. PER CURIAM Panel consists of Justices Christopher, Donovan, and Jewell. 2
