VALERO REFINING - TEXAS L.P., Appellee On Appeal from the 56th District Court Galveston County, Texas Trial Court Cause No. 11-CV-1442 MEMORANDUM OPINION This is an appeal from a judgment signed March 20, 2013. We issued an opinion and judgment reversing the trial court’s judgment and remanding the case to the trial court on March 31, 2015. The parties filed cross-petitions for review in the Supreme Court of Texas, which were granted. On February 24, 2017, the supreme court issued an opinion and judgment reversing our judgment and remanding the case to this Court. Appellant filed a motion for rehearing in the supreme court. While the motion for rehearing was pending, the parties entered into a settlement agreement resolving this matter. Appellant withdrew its motion for rehearing, and the Supreme Court issued its mandate on June 16, 2017. The appeal is now pending in this court on remand from the Supreme Court. On June 22, 2017, appellant filed a motion to dismiss the appeal. See Tex. R. App. P. 42.1(a)(1). The motion is granted. Accordingly, the appeal is dismissed.
