By letter dated November 10, 2017, we informed appellant the court reporter notified us that the reporter’s record had not been filed because appellant had not paid for the record. We requested appellant to provide certain documentation within ten days of our letter and that failure to do so might result in the appeal being ordered submitted without a reporter’s record. Our letter was returned with the notation “Return to Sender, Vacant, Unable to Forward.” On January 25, 2018, we ordered the appeal submitted without a reporter’s record. As a result, appellant’s brief was due on February 24, 2018. On February 28, 2018, we sent a postcard to appellant’s last known mailing address notifying him that his brief was past due. We directed appellant to file both his brief and an extension motion within ten days. We cautioned appellant that failure to file his brief and an extension motion could result in the dismissal of this appeal without further notice. To date, appellant has not filed his brief, an extension motion or otherwise corresponded with the Court regarding the status of his brief or his current mailing address. Accordingly, we dismiss this appeal. See TEX. R. APP. P. 38.8(a)(1); 42.3(b)(c). /Ada Brown/ ADA BROWN JUSTICE 171084F.P05 –2– Court of Appeals Fifth District of Texas at Dallas JUDGMENT LASHON A.
