Dismissed w.o.j. and Opinion Filed November 16, 2017 In The Court of Appeals Fifth District of Texas at Dallas No. 05-17-01315-CV IN RE ALFRED LEE STONE, Relator Original Proceeding from the 283rd Judicial District Court Dallas County, Texas Trial Court Cause No. F91-42452 MEMORANDUM OPINION Before Justices Lang-Miers, Myers, and Boatright Opinion by Justice Myers In this original proceeding, relator seeks a writ of mandamus directing Judge Mary Murphy, Presiding Judge of the First Administrative Judicial Region of Texas, to rule on and grant a motion to recuse the district court judge assigned to relator’s case. This Court lacks writ jurisdiction over Judge Murphy because she is not a judge of a district or county court in this Court’s district and our jurisdiction is not in jeopardy such that we could exercise writ jurisdiction. See TEX. GOV’T CODE § 22.221(a), (b); see also In re Michael Hooper & Assocs., P.C., No. 05-09-01291-CV, 2009 WL 3647580, at *1 (Tex. App.—Dallas Nov. 5, 2009, orig. proceeding) (mem. op.) (no writ jurisdiction over regional administrative judge); In re Hettler, 110 S.W.3d 152, 154, 155 (Tex. App.—Amarillo 2003, orig. proceeding) (no writ jurisdiction over presiding judge of an administrative judicial region). Accordingly, we dismiss this proceeding for want of jurisdiction. 171315F.P05 /Lana Myers/ LANA MYERS JUSTICE –2–
